Arbitration

The Arbitration Committee is a tribunal charged with resolving disputes within the Union of Baptist Churches in the Netherlands. The arbitration rules are part of the "Work Order Service Centre Union of Baptist Churches (DUB) ', which here can be downloaded.

 

In November 2008 the following members of the committee appointed: Dr H. de Boer from The Hague, Mr. MM den Boer from The Hague and Professor Dr FP de Vries from Houten. The alternate member was added Rev. Chr. Eijer from Amersfoort.

 

 

 

 

 


First Union Arbitration award

 

 

 

 

In December 2008, the Arbitration Commission received its first application. This request led to a ruling of May 9, 2009. The Arbitration Committee now has a binding ruling on a dispute between a Baptist congregation and its pastor.

 

Both disagreed on how they have gone out together.The Arbitration Committee has now held that - even if not intended congregation and pastor - there is an employer and employee relationship. This deviation from the Guide of the Union of presiding as a special legal relationship consider that a line can not be put to a contract.

 

 

The Baptist congregation and its pastor were among others disagree with what the pastor has to work for the community to provide the date on which he had terminated his employment explicitly. That disagreement could not be solved by both of them. The Arbitration Committee has now decided that the Baptist congregation compensation to the pastor to pay because the city also has a responsibility to the pastor after the employment relationship in this situation where the pastor does not have adequate resources were available and the town, knew when predecessor connection with the municipality voluntarily terminated.
